Terms of Service

• You are either a Covered Entity or Business Associate as defined under HIPAA
• You are solely responsible for ensuring your use of this platform complies with all applicable HIPAA regulations
• Handling patient information within the bounds of HIPAA law is your paramount responsibility as a licensed provider
• You are responsible for maintaining appropriate administrative, physical, and technical safeguards for any patient information accessed through this platform
• All AI-generated clinical notes must be reviewed, edited, and approved by a licensed provider before use in any medical record or billing submission
• You will not use this platform in any manner that violates HIPAA or any other applicable federal or state law

• Maintaining appropriate security safeguards for data stored on our platform
• Using industry-standard encryption for data in transit and at rest
• Not selling or sharing your patient data with third parties
• Working to establish Business Associate Agreements with technology vendors that process protected health information
• Notifying you promptly of any security incident that may affect your data

• Reviewed by a licensed provider before clinical use
• Edited for accuracy and completeness
• Approved before inclusion in any medical record or billing submission

Smart Documentation Assistant does not guarantee the accuracy of AI-generated content. The provider assumes full clinical and legal responsibility for all documentation submitted under their name or credentials.

• Maintaining the confidentiality of your login credentials
• Not sharing your account with unauthorized users
• Logging out from shared or public devices
• Notifying us immediately of any unauthorized access to your account

• Subscriptions are billed monthly
• 14-day free trial — no credit card required to start
• Cancellation takes effect at the end of the current billing period
• All fees are non-refundable except as required by law

Pricing Changes. The Company reserves the right to modify, increase, decrease, or otherwise adjust the pricing, fees, subscription rates, or charges for its services at any time when reasonably necessary based on the Company’s financial, operational, business, or strategic decisions. Any pricing change that affects an existing customer will be communicated to that customer in advance with reasonable prior notice before the new pricing becomes effective. Continued use of the service after the effective date of a pricing change constitutes acceptance of the revised pricing.

• Use this platform for any purpose other than legitimate clinical documentation
• Attempt to reverse engineer, copy, or replicate the platform
• Use the platform to generate fraudulent or misleading clinical documentation
• Share your account credentials with unauthorized individuals

• Clinical errors in AI-generated notes not caught during provider review
• Any adverse patient outcomes resulting from use of AI-generated documentation
• Any damages arising from unauthorized access to your account due to your failure to maintain account security
• Indirect, incidental, or consequential damages of any kind
